Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or applicable law. We will post the updated version on the Site and revise the "Last updated" date. If a change materially reduces your rights, we will provide additional notice (for example, by email or a notice on the Site) before the change takes effect. We review this Privacy Policy at least once every 12 months.
Personal information we collect
"Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household. It does not include de-identified or aggregated information. The categories we collect depend on how you interact with us.
Information you provide to us
- Identifiers and contact details — name, shipping and billing address, email address, phone number, and, if you create an account, your username and password.
- Order and commercial information — products purchased or considered, order history, order value, and returns or exchanges.
- Payment information — payment card details and billing information are collected directly by our payment processors (see "How we disclose personal information"); we receive only a token, the last four digits, card type, and transaction confirmation. We do not store full card numbers.
- Communications — the content of emails, texts, chat messages, phone calls, reviews, survey responses, contest entries, and social-media messages you send us, and our notes about them.
- Marketing preferences — whether you have subscribed to emails or texts, and your interests or preferences if you tell us about them.
- User-generated content — reviews, photos, videos, or testimonials you submit or tag us in, including any people who appear in them.
Information collected automatically
- Device and connection information — IP address, browser type and version, operating system, device type and identifiers, screen resolution, language, and referring URL.
- Usage and browsing information — pages viewed, products viewed or added to cart, searches, clicks, time on page, scrolling, and the date and time of visits, collected through cookies, pixels, tags, and similar technologies (see "Cookies and tracking technologies").
- Approximate location — city or region inferred from your IP address. We do not collect precise geolocation.
- Inferences — conclusions we or our partners draw from the above, such as products you may be interested in.
Information from other sources
- Service providers and partners — Shopify, payment processors, shipping carriers, and advertising platforms may provide us with information about your transactions, deliveries, or interactions with our ads.
- Social-media platforms — if you interact with our pages or ads on Meta, TikTok, Pinterest, or similar platforms, we may receive information consistent with your settings on that platform.
- Publicly available sources — such as public social-media profiles when you tag or mention us.
Sensitive personal information
We do not intentionally collect sensitive personal information (such as government identification numbers, precise geolocation, racial or ethnic origin, religious beliefs, health information, biometric data, or information about sexual orientation) and we ask that you do not send it to us. Payment card information is collected only by our payment processors for the purpose of completing your purchase. We do not use or disclose sensitive personal information for any purpose other than completing your purchase.
If you choose not to provide information
Some information is necessary to provide the Services. For example, we cannot ship an order without a shipping address or process a payment without payment details. If you choose not to provide required information, you may not be able to use certain features.
How we use personal information
We use personal information for the following purposes:
- To provide the Services and fulfill orders — process payments; pack and ship orders through our fulfillment partner; send order, shipping, and delivery notifications; process returns, exchanges, and warranty claims; manage your account; and provide customer support.
- To communicate with you — respond to your questions and requests, send service and policy updates, and ask for feedback or product reviews after a purchase.
- For marketing and advertising — send promotional emails about products, offers, and events; send promotional text messages only if you have expressly opted in; show you MyFort advertisements on other websites, apps, and social platforms based on your interactions with the Site; build audiences of people similar to our customers; and measure the effectiveness of our marketing.
- To improve and personalize the Services — analyze how visitors use the Site, remember your cart and preferences, test new features, and develop new products.
- For security and fraud prevention — detect, investigate, and prevent fraudulent transactions, chargebacks, abuse, and unauthorized access, and protect the safety and rights of our customers and our business.
- For product safety — contact you about a product recall or safety notice for a product you purchased, which we may be required to do under consumer product safety laws.
- For legal compliance and protection — comply with tax, accounting, consumer-protection, and other legal obligations; respond to lawful requests; enforce our Terms of Service; and establish, exercise, or defend legal claims.
- For business operations — internal reporting, audits, financing, and, if applicable, evaluating or completing a merger, acquisition, or sale of assets.
- With your consent — for any other purpose we describe at the time of collection or that you agree to.
We may also create and use de-identified or aggregated information that cannot reasonably be linked to you. We commit to maintaining such information in de-identified form and not attempting to re-identify it.
We do not engage in profiling that produces legal or similarly significant effects about you, and we do not sell personal information in exchange for money.
How we disclose personal information
We disclose personal information to the following categories of recipients, in each case only as needed for the purposes described above:
- Ecommerce platform — Shopify Inc. Shopify hosts the Site, processes orders and accounts, provides checkout, analytics, email, and marketing tools, and provides Shop Pay and the Shop app. See "Our relationship with Shopify."
- Payment processors. Shopify Payments (operated with Stripe), Shop Pay, PayPal, Apple Pay, Google Pay, and any other payment method offered at checkout receive the information needed to process your payment and prevent fraud. Each operates under its own privacy policy.
- Order fulfillment — Regal Logistics. Our third-party logistics provider, Regal Logistics (Fife, Washington), receives your name, shipping address, phone number, email (for delivery notifications), and order contents to pack, ship, and process returns of your order.
- Shipping carriers. UPS, USPS, FedEx, and other carriers receive your name, address, phone number, and email to deliver packages and send tracking notifications.
- Advertising and analytics partners. Meta Platforms (Facebook and Instagram), Google (Google Analytics and Google Ads), TikTok, and Pinterest collect device identifiers, cookie identifiers, IP address, browsing activity, and purchase events on the Site through pixels and tags we have installed, and combine that information with information they hold about you to deliver and measure MyFort advertising and to build advertising audiences. Under some state laws this is a "sale," "sharing," or "targeted advertising." You can opt out as described under "Your privacy rights and choices."
- Email and SMS providers. Shopify Email or a similar email service provider (such as Klaviyo) sends our marketing and transactional emails. If you opt in to text messages, an SMS provider such as Shopify or Klaviyo delivers them on our behalf.
- Customer support, reviews, and survey tools. Vendors that help us manage inquiries, collect and display product reviews, and run surveys.
- Professional advisors and insurers. Accountants, lawyers, auditors, insurers, and similar advisors as needed to operate our business.
- Corporate transactions. A buyer, successor, or investor in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, subject to this Privacy Policy.
- Legal, safety, and compliance. Courts, regulators, law enforcement, and other parties when we believe disclosure is required by law, subpoena, or legal process, or is necessary to protect the rights, property, or safety of MyFort, our customers, or others, to investigate fraud, or to enforce our agreements.
- With your direction or consent. For example, if you agree to have your review or photo featured.
Content you post publicly — reviews, comments, or social-media posts that tag us — is visible to others and may be used by them. We are not responsible for how third parties use information you make public.
Our service providers and contractors are contractually restricted from using personal information for any purpose other than performing services for us, except as permitted by law.
Our relationship with Shopify
The Site is powered by Shopify Inc. ("Shopify"), which also provides Shop Pay and the Shop app. When you use the Services, Shopify collects and processes personal information on our behalf as our service provider under the terms of our agreement with Shopify. Shopify also uses certain personal information for its own purposes as an independent controller — for example, to operate and improve Shop Pay and the Shop app, to detect and prevent fraud across the Shopify platform, to comply with law, and, where you have agreed, to personalize your experience across Shopify-powered stores. Those uses are described in the Shopify Consumer Privacy Policy at https://www.shopify.com/legal/privacy/customers. You may exercise rights regarding information Shopify holds about you as an independent controller through the Shopify Privacy Portal at https://privacy.shopify.com.
Cookies and tracking technologies
We and our partners use cookies, pixels (web beacons), tags, software development kits, and similar technologies ("cookies") on the Site. Cookies are small text files stored on your browser or device that allow the Site to function and to recognize you across visits. We use cookies for the following purposes:
- Strictly necessary — required to operate the Site: keep items in your cart, complete checkout, remember your privacy choices, and protect against fraud. These cannot be disabled.
- Performance and analytics — help us understand how visitors use the Site (for example, Shopify analytics and Google Analytics).
- Functionality — remember your preferences, such as language or currency.
- Advertising and marketing — set by Meta, Google, TikTok, and Pinterest to show you MyFort ads on their platforms and elsewhere, to measure ad performance, and to build audiences. These are the cookies covered by the "Do not sell or share my personal information" opt-out.
Examples of cookies set by Shopify to operate the Site include _shopify_y and _shopify_s (analytics and session), cart, cart_sig, cart_ts, and keep_alive (shopping cart), _secure_session_id (checkout), and _tracking_consent and _cmp_a (recording your privacy preferences). Shopify maintains a current list at https://www.shopify.com/legal/cookies. Advertising partners set their own cookies (for example, _fbp from Meta, _ga and _gid from Google, _ttp from TikTok, and _pin_unauth from Pinterest).
Your cookie choices
- Use the cookie banner on the Site (where displayed) to accept or reject non-essential cookies.
- Click "Do not sell or share my personal information" in the Site footer to opt out of advertising cookies at any time.
- Turn on Global Privacy Control (GPC) in a supported browser or extension. We treat a GPC signal as a valid request to opt out of targeted advertising and the sale or sharing of personal information for that browser.
- Adjust your browser settings to block or delete cookies. Blocking strictly necessary cookies may prevent checkout from working.
- Opt out directly with our partners: Meta (https://www.facebook.com/ads/preferences), Google (https://adssettings.google.com and the Google Analytics opt-out add-on at https://tools.google.com/dlpage/gaoptout), TikTok (https://www.tiktok.com/legal/privacy-policy), and Pinterest (https://help.pinterest.com/en/article/personalized-ads-on-pinterest). Industry tools: https://optout.aboutads.info and https://optout.networkadvertising.org.
Other than Global Privacy Control, we do not currently respond to browser "Do Not Track" signals, because no common industry standard for them has been adopted.
Marketing communications
If you subscribe or make a purchase, we may send you marketing emails about MyFort products, offers, and events. Every marketing email includes an unsubscribe link and our postal address, as required by the CAN-SPAM Act. You can also unsubscribe by emailing info@myfort.com. We process unsubscribe requests within 10 business days. Even after you unsubscribe, we will continue to send transactional messages such as order confirmations, shipping updates, and recall or safety notices.
Text messages (SMS)
We send marketing text messages only to people who have expressly opted in by providing a mobile number and agreeing to receive texts. Consent to receive marketing texts is not a condition of purchase. Message frequency varies; message and data rates may apply. Reply STOP to any message to opt out, or HELP for help. We will send one final message confirming your opt-out. Carriers are not liable for delayed or undelivered messages. We do not share mobile opt-in information with third parties for their own marketing.
Interest-based advertising
We advertise on platforms operated by Meta, Google, TikTok, and Pinterest, and we may share hashed email addresses or use pixel data to show ads to existing customers or to people similar to them. See "Cookies and tracking technologies" and "Your privacy rights and choices" for how to opt out.
Children's privacy
MyFort products are designed for children, but the Services are designed for and directed to adults. You must be at least 18 years old to make a purchase or create an account. We do not knowingly collect personal information from children under 13 online, and we do not knowingly collect, sell, or share the personal information of anyone under 16. If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete it. If you believe a child has provided us with personal information, contact us at info@myfort.com with "PRIVACY REQUEST" in the subject line.
When a parent or guardian provides a child's first name, age, or a photo of a child (for example, in a review, a customer-service inquiry, or a social-media tag), we treat that information as the parent's or guardian's personal information, use it only for the purpose it was provided, and do not use it to market to the child.
User-generated content and photos
We love seeing MyFort in your home. This section explains how we may use photos, videos, reviews, and other content you share with us ("Content"). The license terms below are also part of our Terms of Service.
- Content you submit directly to us — by uploading Content through the Site (including product reviews and photo uploads), emailing it to us, sending it to us by text or direct message, or attaching it to a customer-service inquiry, you grant MPKS Ventures LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit, crop, display, and distribute that Content, together with your first name, last initial, and social-media handle, on the Site, in our emails and texts, on our social-media channels, and in our advertising, without further notice or payment to you.
- Content you tag on social media — if you post Content on a social-media platform that tags @myfort or uses a MyFort hashtag, we may ask permission to share it by replying to your post. By replying with "#MyFortYes" (or otherwise expressly agreeing), you grant us the same license described above. Simply posting or tagging us does not by itself grant a license; we will not repost Content from social media without your reply.
- Children — when a child appears in Content, the license must be granted by the child's parent or legal guardian. By submitting or approving Content that includes a child, you represent that you are that child's parent or legal guardian, or have their permission.
- Your representations — you represent that you own the Content or have permission from everyone who appears in it, and that our use of it as described will not violate anyone's rights.
- Withdrawing permission — you may withdraw the license at any time by contacting us at info@myfort.com with "PRIVACY REQUEST" in the subject line. We will remove the Content from channels we control within a reasonable time (generally 10 business days), although we cannot recall printed materials or advertisements already running, and copies may remain on third-party platforms or in cached form.
Reviews you submit through the Site may be displayed publicly with your first name and last initial. Content you post publicly on social media is governed by that platform's terms and is visible to others regardless of anything we do.
Your privacy rights and choices
We extend the following rights to all U.S. residents regardless of state, in addition to any rights you have under the law of your state. Where rights differ, we apply the version most favorable to you.
- Right to know / access — confirm whether we process your personal information and obtain a copy of it, including the categories collected, sources, purposes, and the categories of third parties to which it was disclosed, sold, or shared.
- Right to correct — correct inaccurate personal information.
- Right to delete — request deletion of your personal information, subject to exceptions (for example, we must keep transaction records for tax and accounting purposes and to complete an order you have placed).
- Right to data portability — receive personal information you provided to us in a portable, readily usable format.
- Right to opt out of targeted advertising and the sale or sharing of personal information — click "Do not sell or share my personal information" in the Site footer, use the cookie banner, enable Global Privacy Control, or email info@myfort.com with "PRIVACY REQUEST" in the subject line. Opt-outs made through the footer link or GPC apply to the browser and device you are using; to opt out across devices, please email us.
- Right to opt out of profiling — we do not profile you in furtherance of decisions that produce legal or similarly significant effects.
- Right to limit use of sensitive personal information — we do not use sensitive personal information in a way that would trigger this right, but you may contact us with any concern.
- Right to non-discrimination — we will not deny you goods or services, charge different prices, or provide a different level of service because you exercised a privacy right.
- Right to appeal — if we decline all or part of your request, you may appeal by replying to our decision email with "PRIVACY APPEAL" in the subject line. We will respond within 45 days and explain any decision in writing. If your appeal is denied, we will provide a way to contact your state attorney general.

- Phone: 713-543-0227.
- Mail: MPKS Ventures LLC, Attn: Privacy Request, PO Box 70091, Houston, TX 77270.

Verification
To protect your information, we must verify your identity before fulfilling access, correction, deletion, or portability requests. We typically do this by matching the information in your request to information in our records (such as the email address, name, and recent order details on file) and by sending a confirmation email to the address on file. We may ask for additional information if needed; we will use it only for verification and delete it afterward. Opt-out requests do not require verification, but we may ask for enough information to apply the opt-out.
Authorized agents
You may designate an authorized agent to make a request on your behalf. The agent must provide written, signed permission from you (or a power of attorney), and we may still require you to verify your own identity directly with us. Parents and legal guardians may make requests on behalf of their minor children.
Timing
We will confirm receipt of your request within 10 business days and respond within 45 days. If we need more time (up to an additional 45 days) we will tell you why. We will provide information free of charge up to twice in a 12-month period; requests beyond that, or requests that are manifestly unfounded or excessive, may be subject to a reasonable fee or declined, and we will explain why.
Account, orders, and communication settings
If you have an account, you can view and update your information, saved addresses, and order history by logging in. You can unsubscribe from marketing emails using the link in any email and from texts by replying STOP. To close your account, contact us.
State privacy laws
A number of U.S. states have enacted consumer privacy laws that give residents rights over their personal information. Whether or not a particular state law applies to MPKS Ventures LLC, we offer the rights described in "Your privacy rights and choices" to all U.S. residents, we honor Global Privacy Control signals as opt-out requests, and we do not sell personal information for money or process sensitive personal information beyond what is needed to complete your purchase. If we decline a request, you may appeal as described above, and you may also contact your state attorney general.
Where your information is processed
The Services are operated from the United States and are intended for customers located in the United States. We do not currently ship outside the United States. Your information is stored and processed primarily in the United States by us and by our service providers.
Data retention
We keep personal information only as long as necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law. In deciding how long to keep information we consider the nature of the information, the purpose for which it was collected, legal and accounting requirements, and the risk of harm from unauthorized use or disclosure. Our general retention periods are:
| Information | Retention period |
|---|---|
| Order, payment-confirmation, and tax records | At least 7 years after the transaction, to meet tax, accounting, warranty, and product-safety obligations |
| Account information | While your account is active; deleted or anonymized within 90 days after you close it, except records we must keep |
| Customer-service communications | 3 years after the matter is closed |
| Marketing subscriptions | Until you unsubscribe or after 24 months of inactivity; unsubscribe records are kept indefinitely so we can honor your choice |
| Cookies and analytics data | Per cookie lifetimes under "Cookies"; Google Analytics data up to 26 months |
| Privacy-request records | 24 months |
| User-generated content we have featured | Until you withdraw permission or 3 years after last use |
When information is no longer needed, we delete it, anonymize it, or securely isolate it until deletion is possible.
Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against loss, theft, and unauthorized access, use, alteration, or disclosure. These include encryption of the Site in transit (TLS), payment processing through PCI-DSS-compliant providers, access controls limiting who at MyFort and our vendors can see personal information, and contractual security requirements for service providers. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please keep your account password confidential and never send full payment card numbers by email or text. If we become aware of a security incident that compromises your personal information, we will notify you and the appropriate regulators as required by applicable law, including the Texas Business and Commerce Code and the breach-notification laws of your state.
Third-party websites and services
The Site may contain links to websites, apps, or services operated by third parties, including social-media platforms, payment providers, and shipping carriers. Those third parties have their own privacy policies, and we are not responsible for their practices. We encourage you to review their policies before providing personal information. Our inclusion of a link does not imply endorsement.
Accessibility
We are committed to making this Privacy Policy accessible. If you have difficulty reading it or need it in an alternative format, contact us at info@myfort.com or 713-543-0227 and we will provide it in a format that works for you.
